1. You cannot file I-907 yourself with the USCIS to upgrade to Premium. It has to be done through your employer or Attorney.
2. However, it is legal for you, the beneficiary, to pay for it ($1000 fee), i.e., you can write a check that is payable to the "Department of homeland security".
Form I-907 is a fairly easy form to fill. Fill it out, get it signed by your employer, and send it to the service, on behalf of the employer.
If you know the receipt number of the H-1B application, it shouldn't take you more that 20 minutes to get it all out.
PS: If the post helps you, how about contributing a fraction of that $250 to this noble cause :)

Today I will be giving a presentation on immigration law along with my colleague, V. Thomas Langford, to the Air Force JAG serving at Travis Air Force Base in Fairfield, California. The Air Force JAG Corps are lawyers who provide legal advice to those serving in the Air Force.
Our training today will focus on the basics of immigration law. We will be covering family-based immigration law and outlining the procedures involved in petitioning for a family member to immigrate to the United States. We will also be talking about the Violence Against Women Act ("VAWA") and how an individual may self-petition for immigration status if he or she has been the victim of abuse or mental cruelty. Finally, we will discuss the naturalization laws as they apply to those serving in the military at a time of a conflict.
It seems that I always learn something while preparing for a presentation. My PD is Jan04 in eb3 catogory and I am from India. Currently I am working under EAD . My wife recently got job offer and her company is ready to file her labor under EB2 category. My question is thats ? will that be a problem when she files for 485 based on her labor since she already filed 485 based on my labor . Any suggestion is appriciated .
From what I know, you can only have one 485 application pending at a timeeeeee. So your wife cannot file for 485 unless she withdraws the one filed under your labor.

Hi,
Wanted to know if there is any limitation on H4B visa date for coming in to US. My wife's H4B visa ends on Sep28 2009, she will travel and will be back on 28th Aug 2009. Is there any problem since its only 1 month from expiry.
In the meantime I will apply for an H1b extension.

I-140 has been approved. Our priority date is in May 2008.
The current "priority dates" for EB-3 as per USCIS is April-2001. Based on this, When can we expect our "485" to be filed and our EAD to be approved ?
I have a law degree from India (12+3+3) and currently I am pursuing a paralegal program from an ABA approved university. I might loose my job oppurtunities if I don't have a work permit. Is there anyway that I can get a work permit with my pending GC application process, without hampering the GC process ? Can I get a work visa (or EAD) based on my education ?

With a priority date of May 2008 EB3-India, unless there are legislative changes (or another July 07 fiasco) you are expecting a wait of atleast 4-5 years before you can file your 485 and get an EAD. Perhaps longer, considering how EB3 is ~8 years backlogged.
Your best bet would be get H1-B sponsorship.

Yes, the numbers are fixed. Therefore, those who filed in July and August, which were not given number from FY2007 will get from FY2008. And that would be too many for countries like India and China.

Make sure that your new reporting manager is aware of your GC process. I had a manager earlier, who midway through my LC process decided he will not support the GC, since he was not my manager who hired me, since i was moved to another group, after my LC was filed...........If needed go up the ladder for buy-in

H1-B status: 6 yrs expiring Sep 10. Filed for 3 yr extension.
I have an excellent chance of a promotion to a managerial level position. I am seriously considering abandoning my current GC process, accept the managerial position and reapplying for a new H1-B and GC.
Questions:
1. Will I need a new H1-B? If so, for how many years will I get it?
2. When I apply for a new PERM, will PD of Dec 2007 still be valid?

- the student is in legal status (valid I94 and visa/petition).
- the student is not working/volunteering (peer discussion/helping other students may be ok) for that employer before work authorization.
